Tinjauan Yuridis Tentang Kejahatan Cyberbullying di Media Sosial (CD + Cetak)

The development of people’s needs in science and technology especially computer and internet has a very important role, either in the positive side or in the negative side. The most disturbing cyber crime which is still developing rapidly is the crime that related to the privacy of a human being, called cyber bullying. The issues that are being raised are the application of positive law about cyberbullying as one of cybercrime crimes and the causes of cyberbullying crimes that occur in social media.
The purpose of this paper to understand positive legal aggrements regarding cyberbullying crimes as cyber crime and the causes of bullying crime that occur in the social media . The paper uses the normative research methods,
due to the vacancy norm against cyber bullying in the Act Number 11 of 2008 on Information and Electronic Transaction which has been changed in the Act Number 19 of 2016 on Information and Electronic Transaction. This types of cyber bullying consists of flamming action, harassment, impersonation, outing (spreading other people's secrets), trickery, exclusion, cyberstalking, but in the Act Number 11 of 2008 on Information and Electronic Transaction only regulates the act of threatening and humiliation.
The result of this study indicate that cyberbullying is a new type of crime when viewed frim the media used, namely electronic media, the easier it is to make social media as a place to commit cyberbullying crimes, frim several
reasons intended to meet aggressive attitudes and personal feel great that dominates people, then this matter must be the concern of law enforcers where cyberbullying is increasingly widespread in social media. Therefore for this
cyberbullying phenomenon the application of the law. The positive crime of cyberbullying has been explainedpursuant to article 27 paragraph 3 of law number 19 of 2016 amandement to law numer 11 of 2008 concerning information
and electronic transactions, and has a link beetwen article 310 KUHP and 311 KUHP and Constitutional court decision number 50/PUU-VI/2008 concernibf the offense of complaint refers to the phenomenon of cyberbullying.
