The issues raised in this study are particularly related to the existence of a judge's determination regarding the request for sex reimbursement, for which there are no specific rules governing. The impact of the request for sex reimbursement that is not accompanied by the development of existing law in Indonesia, then there is a legal vacuum that causes the Indonesian judiciary to require legal standing for judges to avoid legal disparities in similar decisions. The purpose of this study is to find out and describe the ratio decidendi in determining judges for a request for sex reimbursement as well as the legal consequences of changes in the civil status of perpetrators of sex reimbursement. The method used in this research is the normative method and then conducts a legislative approach, case approach and through comparison of the determination of judges related to the same case. The results showed that the judge was known in providing the determination based on several considerations and there were several legal consequences for the change in the civil status of the perpetrators of the sex replacement. The conclusion obtained is that the judges in giving consideration include the consideration of psychological factors, health factors (medical), social factors, and religious factors, as well as legal consequences received including in recording status changes in the Office of Population and Civil Registry, in the review towards marriage as well as in inheritance law.
