Hate Speech gets more attention from the public and law enforcement officials. It can lead to incitement, discrimination, violence, even the split of the nation. And that becomes the target is the community of culture, ethnicity, race, and religion. With the presence of this background, the authors draw two formulation of the problem, namely the limitation of the definition of criminal offenses related to hate speech and enforcement against criminal offenses related to hate speech.
This research is a descriptive qualitative research, which follow the pattern of deduction to answer the problem in the object of research, namely data that have been obtained are arranged with the preparation of the form data, then do the reduction or the management of data, generating presentation data, and so on is taken the conclusion. The primary data source of this research is by means of interviews conducted directly by the researcher (interviewer) and officer (interviewees), as well as secondary data obtained from the law and previous journal.
The results showed that to give the limitation of ordinary criminal act with a criminal act of hate speech requires identification. The trick is to give attention to the elements of hate speech in the content of hate speech. Law enforcement officers in enforcing the law is already in accordance with the following laws and regulations based on the Criminal Code with articles related to hate speech, Law No. 11 of 2008 concering about Information and Electronic Transactions, Law No. 19 of 2016 concering about change over Law No. 11 of 2008, The Circular Letter Of The Police No : SE/6/X/2015 concering about handling hate speech
