Indonesia is state law with civil law system that still have used some regulation
from Netherland including KUHP or criminal code. Criminal code is the written
law that regulated about types of crime and the penalties. According to article No.
10 KUHP the heavier punishment is death penalty. In the case the crime is not yet
regulated in KUHP, it will regulate in separated Act. As Act. No. 23/2002 that has
a view changes with Act. No. 35/2014 on Child Protection. Usually the crimes
which regulated in separated Act. are categorized as extra ordinary crime.
Indonesia in recently has a serious case about child sexual abuse that reach 1,726
cases. Especially on April, 2016 there is child sexual abuse that experienced by
the child named Yuyun who was 14 (fourteen) years old became a rapist victim
that commit by 14 (fourteen) perpetrators. By looking at this case finally
Indonesian Government made a new regulation on May 25, 2016. The new
regulation is Peraturan Pengganti Undang-Undang (Perpu) or Government
Regulation in Lieu of Law No.1/2016 on castrated punishment for the perpetrators
of child sexual abuse as a special law. It has contained of principal punishment
and additional punishment. The principal punishments for perpetrators of sexual
child abuse are death penalty, life sentence, and minimal imprisonment is 10 years
or maximal imprisonment is 20 years. The additional punishment consist of
chemical castrated for the perpetrators of child abuse, gives chip to the
perpetrators of sexual child abuse to be can monitored and publication the identity
of child sexual abuse perpetrators.
